The human readable text isnt very clear to me on one specific point:
You are free:
* To sample, mash-up, or otherwise creatively transform this work for commercial or noncommercial purposes.
* To perform, display, and distribute copies of this whole work for noncommercial purposes (e.g., file-sharing or noncommercial webcasting).
Under the following conditions:
* You must attribute the work in the manner specified by the author or licensor.
* You may not use this work to advertise for or promote anything but the work you create from it.
* For any reuse or distribution, you must make clear to others the license terms of this work.
Does this mean that somebody cant do for example a radio commercial with freesound samples? (although it would be difficult to attribute but thats another story).
Cheers
Yes Anton, It does mean what you state. You cannot use them for commercial except commercials about the work in which the samples are used.
Now I'm confused...
What if you created a song with freesounds and released it commercially and that song ends up in a commercial?
thats an interesting scenario Noise Collector!
Indeed Anton & Noisecollector, it can all be a bit confusing. I am not a laywer, so I am not really sure sure about this, but from my personal understanding, what Noisecollector describes, would be illegal...
I can understand the point of view of Suva, but I for myself would not contribute my samples when they can be used for commercials for things I don't want to support, like the army, weapons, porn with children or a major multinational using child labor to produce cheaper... So I am happy with the CC license as it is. But of course, that's only my personal point of view.
I agree with Jovica, not only because of "political" reasons, but also for personal and creative reasons. When im sharing my recordings here, i share a great effort by myself, both monetary and time wise. I invest in recording equipement and am also fortunate enough to spend a couple of years studying music and sound at USMT. So while for most part I share this material free of monetary charge I do feel justified in asking to at least be credited. I really enjoy receiving pm's about people using my stuff and they confirm to me that this thing is worthwhile investing more time into.
On the other hand, I do feel its a shame that the ratio between people that share and people that just take is so out of balance. I know this is the reality of life, especially on the internet but that doesnt change the fact that i feel its pretty weird that there are people on this site that leech just about every file uploaded without uploading a single file to the database. Im not kidding, these users exist.
Oh well, happy up/downloading guys, i just approved a couple dozen new sounds.
I agree with Anton. I unfortunately do not work in the field, so I spend a lot more personal time doing things with less resources and I had gotten so much free stuff to make music with that I jumped at the opportunity to give something back. We are bass players so we think logically and that creates tension with reality.
I recently got a message from someone using my samples and it was definitely rewarding to see someone else's creativity using your sounds or even being influenced by your sound.
As far as people not contributing, it does not bother me that much. The world is full of people who expect something for nothing and do not think or care of where these things they feel they deserve come from. That is the way of the world unfortunately.
I agree with Jovica to some extent about the children but I had no idea that anyone advertized that garbage. It's pretty illegal in the U.S. On the other hand, I authorize the Army to use my samples to make cheaper porn with adults only, so long as it is licensed under creative commons license and they credit me.
I do agree with you all. No questions asked.
But though there's an Internet / Web Law or whatever we call it, what we put ON World Wide Web, no matter if its a picture file, sound file, scripts, programs, they are consider for public use and we can hardly TELL if they are using it metalegally... AND WE CANNOT STOP THEM FROM GETTING OR STEALING IT.
There are millions and millions of websites and lots of countries. I believe that, though possible, it is VERY DIFFICULT and HARD to find that person/s who uses it in a bad manner. Additionally, the time, effort, money's wasted on suing that person, and STILL we cannot be sure if we can win the case...
I think internet laws are strictly monitored and granted in US, but what if the accused is residing outside US?
So, in short, whatever we put in the internet, philisophically, is/are for public use already. And my message to all creators, uploaders, makers... "IMMITATION IS THE GREATEST FORM OF FLATTERY."
If you think your work has been stealed, just be flattered that your works are being ripped and stealed because it only means that you are on the top of them and they are under you. Its their conscience anyway. God knows.
Well, its just my thought anyway.
Best,
Mark
as far as I understand creative commons is more about giving the abuser the option of being legally OK while not being restricted. Of course content from freesound can be used illegally, but why would you, if you can easily conform with the rules of the CC legal we use. Obviously this is thinking about without commercials. But seriously, if you're making a commercial, you're getting paid, so it's only a matter of goodwill to contact the author(s) of the sound and asking them for permission.

I agree with all of you just leave it as it be. However those that use it to make a buck should have the decency to inform the author of the sample used that their sample was used.
yes they can use it illegally..by all means please go ahead....however IF I FIND OUT U DID THEN I STILL CAN SUE YOUR ASS NO MATTER WHAT YOU THINK. IF SAY NIKE OR ADDIDAS WAS TO TAKE SOMETHING FROM HERE AND USE IT. DOESN'T MATTER WHAT THEY DID WAS ILLEGAL IT IF NOT ON PAPER AND SIGNED BY BOTH PARTIES INVOLVED.
so please by all means use them illegally. but its safer to be honest. and trust me most of us here WOULD INSTANDLY KNOW ONE OF OUR SOUNDS IF WE HEARD IT.
