Okay, i've read the commons license and searched the forums for an answer to this question : Is it okay to create loops from samples gotten from, say, a sample cd or some other collection? Seems like it would be since the samples are being used in the same manner as in a song, but then again a loop is a kind of sample itself. Any thoughts, or better, a definitive answer ?
I'm gonna say yes. but i mean if u use say a blantant vocal sample? probably not. but it all depends on what u are using
u mean a drum loop? i don't think that's a problem being as most drum hits all sound the same (even tho just about all drum cds claim they dont' but hell its hard to tell one 808 kick sounds like the other so..)
It depends... I do have sample collections which do forbid what you suggest. In fact, most of them forbid to use their sample collections to create other samples... so I would be very careful when doing this.

So it seems clear that in this case samples can be used in a song, naturally. And the line about being used in "a part of a derivative work in any music library or sample library product" seems to forbid the use of samples to construct loops. But does this only cover a commercial release ? And does creating packs of samples here on freesound mean the same as a musical library ? Let alone the bit about the samples being UNMODIFIED. So, for example, if filtered one-shot samples are used to construct a loop, is the loop still a derivative work or something new ?
i would say one shots are okay. like i said one 808 sounds the same as the next (no matter who trys to tell me other wise).
commercial release is more what they are talking about more specificaly
IF U MAKE MONEY OFF IT (thats what this is really all about) they think they did work by putting a universal 808 or any other kinda of one shot on it..so honestly i say fuck them and use it because they are full of shit to begin with (i can hear u people jumping in as i speak).
but say if its a one shot ..of a chopped up loop they made...and u do NOTHING TO FREAK IT OUT AND MAKE IT ORIGINAL...well then i'd sue your ass to.
its this simple..its okay to use your typical snares, kicks hi hats etc. they can't copy right that as much as they claim they can (they can't)...if that was the case then every drummer would be rich.
use the one shots and take the risk thats what i say.

i'm not buying it they are legit. probaby just presets that they stole and added a few effects to. because i've heard some of those loops on cd's before
they aren't original.
but i'm not a snitch so i won't snitch them out.

Summary: don't use easily recognisable samples from sample libraries in loops you put on freesound. In my opinion Freesound falls under the "music library or sample library product" sentence, but I can't be sure. Your best bet would be to ask the people at creative commons to make 100% sure.

LS, the whole point is that you DO SNITCH OUT to make sure this site stays in the legal realm!
Snitching out -in the case of freesound- protects both the user who uploaded the file(s) and freesound!
You snitching out can only result in the samples being removed from freesound.
Some sample-cd company finding out our samples aren't legal could result in suing the user and potentialy shut-down of freesound.

Another question I have is about sampling from digital synths. The sticky states that an unaltered one-shot is unacceptable, but I've seen a couple sample packs that are collections of drum sounds from a particular synth. Am I misunderstanding something ? I'm new to the site and don't want to do anything to jeopardize it.
