I just stumbled across a short recording of a bar, where the background music is clearly identifiable (and clearly copyright!) In my understanding, this would be a "derivative work", and not allowed in such an instance. Or am I wrong - is it ok to include copyright music in a recording in certain instances? I don't mean to be the whistle-blower for this sample - I would just like to check the legality of this kind of thing.

I think it would be trouble some as well because you say its "clearly identifiable"
If its minor background noise and there's other stuff going on it might be in the clear. I'm real unsure how films deal with these kinds of issues where something is shot and there is background music that they might not even be able to truly control. I guess it has to do with whether it is not really the emphasis of the recording.
