If it's a shared product, then they both have rights to it...Unless you want to be weird and say one has rights to the instrumental and one has rights to the Acapella then I suppose that works. I dunno.
actually that is how it works, if the acapella guy doesnt want his vocals to be free then the other guy is not allowed to post the songs with his vocals in it, only the instrumental/beat
depending how popular they really are, some people might not care but they are allowed to sue them if they use their work without their permission, if its uploaded onto soundcloud or something i bet you could get it removed if you file a complaint or something, im not sure
big companies are different, they usually have you agree with some sort of binding contract that allows them to use anything you give them. its something official and is used for legal purposes
but this is something more private and independant, where there is no official statements or anything like that so anything goes, everyone still has the rights to their own work
you can make your own binding contract but if you are not a big company then they might not care about it if you bring it up in court.
first of all you need to be at least 18, any one under this age is not permitted to agree on something official and for any lawful acts to be put upon you
then you need a written statement with the other parties signature
again, most people don't go this far since they're not that big
